Terms of Service

Effective date: July 19, 2026

These Terms of Service (the "Terms") constitute a legally binding agreement between you and Higher Landing Inc. ("Higher Landing," "we," "us," or "our") governing your access to and use of this website, our registration pages, our free live masterclass sessions, our Career Alignment Assessment, our email communications, and any related content, tools, materials, and services we make available (collectively, the "Services").

By accessing the website, registering for a session, completing an assessment, submitting any form, or otherwise using the Services in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms in full. If you do not agree to these Terms, you must not access or use the Services.

1. About the Services

Higher Landing provides career transformation education, coaching programs, and related professional development resources. The Services accessible through this website include, without limitation: registration for free live educational sessions delivered over third party video conferencing platforms, a self guided Career Alignment Assessment, downloadable summaries, and email based educational and promotional communications.

The Services, including the structure, sequence, methodology, frameworks, assessments, scoring approaches, and content used within them, are built on proprietary systems and processes developed by Higher Landing. We are under no obligation to disclose, explain, or document the inner workings of these systems, and nothing in these Terms or in your use of the Services grants you any right to them.

2. Eligibility

The Services are intended for individuals who are at least 18 years of age and who have the legal capacity to enter into a binding agreement. By using the Services, you represent and warrant that you meet these requirements. The Services are not directed at children, and we do not knowingly permit anyone under 18 to register.

3. Registration and Accuracy of Information

When you register for a session, complete an assessment, or submit any form, you agree to provide information that is true, accurate, current, and complete, and to keep it that way. You are solely responsible for the accuracy of all information you submit and for any consequences arising from inaccurate, incomplete, or misleading information.

We reserve the right, in our sole discretion and without notice or liability, to refuse, cancel, or revoke any registration, restrict access to any session, or decline to provide any part of the Services to any person for any reason or no reason.

4. Educational Purposes Only, No Professional Advice

All content, sessions, assessments, results, scores, frameworks, action items, emails, and materials provided through the Services are for general informational and educational purposes only. They do not constitute, and must not be relied upon as, career advice, employment advice, financial advice, legal advice, psychological advice, or any other form of professional advice tailored to your circumstances.

You are solely responsible for evaluating the relevance and suitability of any information provided through the Services and for any decision you make or action you take, or choose not to take, in connection with your career, employment, business, finances, or life. Before making any significant decision, you should consult qualified professionals of your own choosing.

5. No Guarantee of Results or Outcomes

Higher Landing makes no representations, warranties, promises, or guarantees of any kind regarding outcomes, including without limitation: career advancement, career clarity, new roles or opportunities, compensation changes, interview results, professional recognition, business results, or any other personal or professional outcome.

Any examples, statistics, testimonials, or references to the experiences of other professionals presented through the Services are illustrative only, reflect individual circumstances, and are not a promise or prediction of your results. Your outcomes depend on numerous factors outside our knowledge and control, including your own effort, background, market conditions, and timing, and you accept full and sole responsibility for them.

6. The Career Alignment Assessment

The Career Alignment Assessment is a self reported, automated educational tool. Its questions, structure, scoring, staging, and outputs are proprietary to Higher Landing, are provided as is, and are not a diagnostic, psychometric, or scientific instrument. Results are generated from your own responses and are intended only as a general starting point for reflection.

You agree that assessment results carry no warranty of accuracy, completeness, or fitness for any purpose, and that any reliance you place on them is entirely at your own risk.

7. Live Sessions and Third Party Platforms

Live sessions are delivered through third party platforms such as video conferencing and calendar services that we do not own or control. Your use of those platforms is governed by their own terms and policies, and we accept no responsibility or liability for their availability, performance, security, or practices.

We do not guarantee that any session will occur at a scheduled time, be free from technical interruption, or be available in your region. We may reschedule, modify, substitute presenters for, shorten, or cancel any session at any time without notice or liability. Session access links are delivered by email, and you are solely responsible for ensuring you can receive our emails, including checking junk, spam, and promotional folders.

8. Communications Consent

By submitting your email address, and optionally your phone number, through any form on this website, you expressly consent to receive electronic communications from Higher Landing at the contact information you provide, including by email and text message. These communications include session confirmations, access links, reminders, updates, cancellation notices, educational content, assessment results, and marketing and promotional messages about our programs and services. Message frequency varies and standard message and data rates may apply.

You may withdraw your consent to marketing communications at any time using the unsubscribe mechanism included in our emails. Transactional messages related to a registration you have made may still be sent. Our collection and use of your information is further described in our Privacy Policy, which is incorporated into these Terms by reference.

9. Analytics, Tracking, and Advertising Technologies

You acknowledge and agree that the Services use cookies, pixels, browser storage, and similar technologies, together with our own systems and third party service providers, to measure and record how visitors and registrants use the website. This may include pages and sections visited, buttons and links clicked, time spent on the website, whether video content is viewed, whether forms and assessments are started or completed, whether our emails are delivered or opened, and similar engagement measures. Where you have registered, some of this data may be associated with your registration.

You further acknowledge and agree that, as part of our quality assurance and service improvement activities, a portion of eligible visits to the website may be selected for review through experience analytics tools that reconstruct on page activity, such as scrolling, navigation, and interactions with page elements, so that we and our service providers can evaluate usability, identify and resolve issues, and enhance the user experience. The proportion of visits included, and the criteria for eligibility, may change from time to time in our sole discretion and without notice. Fields designed to receive sensitive input are configured to be excluded or obscured from such reconstructions. By accessing or continuing to use the website, you consent to this activity and agree that it forms part of the ordinary operation of the Services. This information is handled as described in our Privacy Policy.

We may also use third party advertising and analytics pixels, including those operated by social media and search advertising platforms, to measure campaign performance and support our marketing. Those platforms operate under their own terms and privacy policies, and we accept no responsibility or liability for their practices. By using the Services, you consent to the collection and use of this information as further described in our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, your sole remedy is to stop using the Services.

10. Intellectual Property

All content and materials available through the Services, including without limitation text, graphics, logos, trademarks, trade names, images, video, audio, page designs, software, assessments, frameworks, methodologies, and the selection and arrangement of all of the foregoing, are the exclusive property of Higher Landing Inc. or its licensors and are protected by Canadian and international intellectual property laws.

You are granted a limited, personal, non exclusive, non transferable, revocable licence to access the Services for your own individual, non commercial use. You may not copy, reproduce, distribute, republish, display, transmit, record, resell, create derivative works from, reverse engineer, or otherwise exploit any part of the Services without our prior written consent. Recording, screenshotting for redistribution, or sharing session content or access links is strictly prohibited.

11. Acceptable Use

You agree that you will not:

  • Use the Services for any unlawful, fraudulent, or malicious purpose;
  • Register using false, misleading, or third party information without authorization;
  • Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Services, related systems, or other users' data;
  • Use automated means, including bots, scrapers, or crawlers, to access or collect anything from the Services;
  • Share, resell, or redistribute session access, materials, or communications;
  • Attempt to discover, replicate, or reverse engineer our proprietary systems, assessments, or methodologies.

We may investigate suspected violations and take any action we consider appropriate, including revoking access and pursuing legal remedies, without notice or liability to you.

12. Assumption of Risk and Personal Responsibility

You acknowledge and agree that your use of the Services, your participation in any session, your completion of any assessment, and any decision or action you take in connection with them are undertaken voluntarily, knowingly, and entirely at your own risk.

You accept full and sole responsibility for all outcomes and consequences, direct or indirect, that arise from or relate to your use of the Services, and you release Higher Landing Inc., its directors, officers, employees, contractors, coaches, presenters, agents, and affiliates from any and all claims, demands, damages, and causes of action of every kind arising from or related to your use of the Services, to the maximum extent permitted by applicable law.

13. Disclaimer of Warranties

THE SERVICES AND ALL CONTENT, MATERIALS, SESSIONS, ASSESSMENTS, AND COMMUNICATIONS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON INFRINGEMENT, ACCURACY, RELIABILITY, OR AVAILABILITY, ALL OF WHICH ARE EXPRESSLY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant that the Services will be uninterrupted, timely, secure, or error free, that defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL HIGHER LANDING INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, COACHES, PRESENTERS, AGENTS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, EMPLOYMENT, OPPORTUNITY, GOODWILL, REPUTATION, OR DATA, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE THEORY OF LIABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE TOTAL AMOUNT YOU PAID TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE THREE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS (CAD $100). BECAUSE THE SESSIONS AND ASSESSMENT OFFERED ON THIS WEBSITE ARE FREE, YOU ACKNOWLEDGE THAT IN MOST CASES THIS AMOUNT WILL BE CAD $100 OR LESS.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, our liability is limited to the smallest amount permitted by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Higher Landing Inc. and its directors, officers, employees, contractors, coaches, presenters, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, judgments, awards, costs, and expenses, including reasonable legal fees, arising out of or in any way connected with: your access to or use of the Services; your violation of these Terms; your violation of any law or the rights of any third party; any information you submit through the Services; or any decision or action you take in reliance on the Services.

16. Third Party Links and Content

The Services may contain links to, or integrations with, third party websites, platforms, and services. These are provided for convenience only. We do not endorse, control, or assume any responsibility for their content, terms, or practices, and your use of them is entirely at your own risk.

17. Suspension and Termination

We may suspend, restrict, or terminate your access to all or any part of the Services at any time, with or without cause, and with or without notice, without any liability to you. All provisions of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, limitations of liability, indemnification, and dispute resolution provisions.

18. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that any dispute will first be raised with us in writing and that the parties will attempt in good faith to resolve it informally for a period of at least thirty days. Any dispute that cannot be resolved informally will be submitted to the exclusive jurisdiction of the courts located in Calgary, Alberta, and you irrevocably consent to the personal jurisdiction of those courts. To the maximum extent permitted by law, you agree that any claim must be brought in your individual capacity and not as part of any class, collective, or representative proceeding, and that any claim must be commenced within one year after the cause of action arises or it is permanently barred.

19. Changes to the Services and These Terms

We may modify, update, or discontinue any part of the Services, and we may revise these Terms, at any time in our sole discretion. Revised Terms take effect when posted to this page with an updated effective date. Your continued use of the Services after any revision constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

20. General Provisions

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Higher Landing regarding the Services and supersede all prior agreements and understandings. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms; we may assign them without restriction. Headings are for convenience only.
